The rule changes by municipality

Start with the city where the property is located.

Brampton, OntarioBrampton requires the applicable zoning compliance, a building permit process and City registration for second and third units.

The City’s ARU program treats legality as a combined permit, inspection and registration workflow. A standard basement-finish permit is not the same thing.

Burlington, OntarioBurlington requires a building permit for ARU construction and requires the application to meet zoning and performance standards for the property.

The City publishes a step-by-step ARU process with a two-business-day screening target and a 10-business-day building-permit review once the application is complete.

Hamilton, OntarioHamilton has a dedicated ADU team for building permits in existing single-family dwellings, including up to two internal units and one detached unit.

An ADU is a separate self-contained residential unit that can be within, added to, or detached from the principal dwelling. Internal ADU work is explicitly included in Hamilton’s permit-required list.

Kitchener, OntarioYes. Kitchener requires a building permit to add a duplex, including projects described as in-law suites, accessory apartments or granny flats.

This is a separate project route from ordinary basement finishing because the work creates another dwelling unit.

London, OntarioA building permit is required for every new ARU, whether it is an interior/basement conversion, converted garage, addition or detached unit.

London treats ARUs as a dedicated permit path with zoning review, site planning and construction drawings.

Markham, OntarioMarkham provides a dedicated secondary-suite process covering eligibility, the building permit application and registration with Markham Fire and Emergency Services.

A secondary suite can be in the basement or another part of the house. It is a distinct permit and registration workflow, not simply a finished-basement project.

Mississauga, OntarioA new or converted second unit needs the applicable building permit work and must meet Building Code, Fire Code and zoning requirements; second units are also registered with the City.

Mississauga treats an additional residential unit as more than a basement finish. Conversion drawings, applicable-law information and registration are part of the route.

Oakville, OntarioOakville requires property-specific zoning review for an accessory apartment and a separate Zoning Certificate of Occupancy approval in addition to the building permit process.

A basement-to-accessory-dwelling conversion is treated as a change that needs zoning approval; the zoning certificate is not itself permission to construct.

Oshawa, OntarioAdding a dwelling unit or apartment requires a building permit, and Oshawa publishes a dedicated 2024 Building Code guide for basement secondary suites.

The guide is for basement secondary suites in existing buildings and distinguishes those projects from detached accessory-building units or third units.

Ottawa, OntarioA building permit is required when the new unit includes specified construction such as an addition, enlarged window, new exterior door or new internal shared entrance; some basement-apartment cases may require only a plumbing permit.

Ottawa’s published guidance is deliberately scope-based. The permit route changes with the work, so define the proposed construction before assuming every secondary unit uses the same application.

Toronto, OntarioAdding a second dwelling unit in an existing house follows Toronto’s secondary suite building permit route.

A basement apartment is a common example. This differs from a finishes-only basement project. The City’s guide covers the drawings and related mechanical or plumbing submissions.

Vaughan, OntarioA new secondary suite must satisfy Vaughan zoning requirements and use the building permit process before construction.

Vaughan’s process begins with property eligibility and zoning. Newer units use the Building Code permit route, while older existing units can involve Fire Code review.

Waterloo, OntarioYes. Waterloo requires a building permit to add an additional residential unit to a home.

For basement or main-floor ARUs, the City also directs applicants to confirm zoning, parking and driveway requirements before filing.

Whitby, OntarioWhitby requires the applicable building permits and registration for ADUs, with property eligibility governed by zoning and Town requirements.

Whitby accepts principal-residence and detached ADU permit applications and requires registration with Enforcement Services. A temporary incentive program is available for qualifying permits under 2026 deadlines.
