The rule changes by municipality

Start with the city where the property is located.

Burlington, OntarioBurlington lists solar collectors not mounted to buildings with a face area under 5 m² as permit-exempt; other solar installations need project-specific permit review.

The City also publishes a building permit requirements package for solar electric and thermal panels, so building-mounted or larger systems should be treated as permit projects unless confirmed otherwise.

Hamilton, OntarioYes. Hamilton lists solar panels among exterior projects that require a building permit.

The building permit covers construction and structural safety. Electrical approvals remain separate.

Markham, OntarioMarkham lists ground- or roof-mounted solar photovoltaic panels among housing projects that do not require a building permit.

That exemption is specific to the City’s building-permit list. Electrical work remains outside the municipal building-permit process and other site or heritage conditions may still apply.

Mississauga, OntarioYes. Mississauga lists solar panels among projects that require a building permit.

The building permit addresses the construction and structural side of the installation. Electrical approvals are a separate responsibility.

Oakville, OntarioOakville requires a building permit when the accumulated face area of the solar panels is at least 5 m².

The Town also requires an engineer to assess the supporting building structure for the solar installation.

Toronto, OntarioIt depends on the system. Toronto says rooftop solar greater than 5 m² needs a building permit, while free-standing ground-mounted solar generally does not require a building permit but must follow zoning.

Solar projects can also require Electrical Safety Authority approval and Toronto Hydro interconnection. The permit path is therefore not just a building-code question.
